#HMOFOUNDIT Monthly Sweepstakes — Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED.

1. Sponsor

The #HMOFOUNDIT Monthly Sweepstakes ("Sweepstakes") is sponsored by Hobby Miner Outlet LLC, located at PO Box 24, Newport, OR 97365 ("Sponsor").

Questions concerning the Sweepstakes may be sent to info@hobbymineroutlet.com with "#HMOFOUNDIT Sweepstakes" in the subject line.

2. Eligibility

The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia who are at least 18 years old and have reached the age of majority in their jurisdiction when entering.

Employees, officers, contractors, agents, and immediate-family or household members of the Sponsor are not eligible.

The Sweepstakes is void where prohibited or restricted by law. Entrants are responsible for determining whether participation is lawful in their jurisdiction.

3. Monthly Entry Periods

Each monthly Sweepstakes begins at 12:00:00 a.m. Pacific Time on the first calendar day of the month and ends at 11:59:59 p.m. Pacific Time on the final calendar day of that month ("Entry Period").

The Sponsor's systems and records are the official timekeeping method.

Each month constitutes a separate Sweepstakes. Entries do not carry forward to later months.

Before each Entry Period begins, Sponsor will publish a Monthly Promotion Notice identifying:

  • The applicable Entry Period;
  • The exact number of winners;
  • The available prize pool;
  • The quantity and approximate retail value of each prize; and
  • Any promotion-specific information permitted by these Official Rules.

If a Monthly Promotion Notice conflicts with these Official Rules, these Official Rules control unless the notice expressly identifies an authorized amendment.

4. How to Enter

There are two free entry methods. No purchase is required under either method.

A. Social-media entry

During the Entry Period:

  1. Create an original public post containing a photograph of a find you made or own.
  2. Include the date the find was made.
  3. Include #HMOFOUNDIT and #Sweepstakes clearly in the post.
  4. Tag Hobby Miner Outlet's official account for that platform:
  5. Keep the post public and available through winner verification.

Use of Hobby Miner Outlet equipment is not required.

B. Alternative free entry

Email info@hobbymineroutlet.com during the Entry Period with the subject: #HMOFOUNDIT Sweepstakes Entry

Include:

  • Your full name;
  • Your state of residence;
  • Your email address;
  • The applicable entry month; and
  • The statement: "I confirm that I am eligible and agree to the #HMOFOUNDIT Official Rules."

No photograph, social-media account, purchase, or product use is required for this method.

Entry limit

Limit one entry per person per calendar day, regardless of entry method. Multiple entries submitted through different methods on the same day will count as one entry. Automated, bulk, fabricated, incomplete, or duplicate entries may be disqualified.

All entry methods provide equal odds.

5. Entry Requirements

An entry must:

  • Be submitted by an eligible entrant;
  • Be original and truthful;
  • Not infringe another person's copyright, trademark, privacy, publicity, or other rights;
  • Not identify or visibly feature another person without appropriate permission;
  • Not encourage trespassing, unlawful prospecting, environmental damage, or unsafe conduct;
  • Not contain obscene, threatening, discriminatory, defamatory, deceptive, or unlawful material; and
  • Comply with the applicable social platform's rules.

The Sponsor may disqualify an entry that does not satisfy these requirements. A good-faith eligibility decision is not based on whether the entry praises or criticizes Sponsor or its products.

6. Winner Selection

After each Entry Period ends, the number of potential winners stated in that month's Monthly Promotion Notice will be selected through a random drawing from all eligible entries received through both entry methods.

The drawing will ordinarily occur within seven business days after the Entry Period closes.

Odds of winning depend on the total number of eligible entries received.

The Sponsor will preserve a record of the applicable entry pool, drawing date, selection method, and selected entries.

7. Prizes and Random Prize Assignment

Each confirmed winner will receive one prize randomly selected from the prize pool published before that Entry Period began.

The Sponsor will document the random assignment of prizes to winners.

The Monthly Promotion Notice will identify the quantity and approximate retail value of every prize in the pool. The total prize value and individual prize-value range will therefore be known before entries open.

A winner may not select, transfer, exchange, or redeem a prize for cash unless the Sponsor expressly permits it in writing.

If an advertised prize becomes unavailable for reasons beyond the Sponsor's reasonable control, Sponsor may substitute a prize of equal or greater approximate retail value.

All federal, state, and local taxes and any expenses not expressly included with the prize are the winner's responsibility.

8. Winner Notification and Verification

Potential winners will be contacted through the social-media account or email address used to enter.

A potential winner must respond within five calendar days and may be required to provide proof of eligibility, a shipping address, and completed eligibility, tax, or prize-acceptance documents.

A potential winner who cannot be contacted, does not respond by the deadline, is ineligible, or does not complete required verification may be disqualified. Sponsor may then select an alternate potential winner randomly from the remaining eligible entries.

A potential winner is not a confirmed winner until verification is complete.

Winner names may be announced after verification.

9. Optional Winner Content and Reviews

A winner is not required to post an unboxing, first-find report, product review, testimonial, endorsement, or other promotional content as a condition of receiving a prize.

If a winner voluntarily publishes content discussing the prize or Sponsor, the winner must disclose the material connection clearly and conspicuously. Suitable language includes:

"Prize provided by Hobby Miner Outlet."

Any review must reflect the winner's honest experience. Sponsor does not require, condition compensation upon, or promise an additional benefit for a positive review.

Optional content will not affect prize delivery, future eligibility, or the entrant's odds in another promotion.

10. Ownership and Limited Content Permission

Entrants retain ownership of their submitted content.

By submitting a social-media entry, the entrant grants Sponsor a nonexclusive, royalty-free license to reproduce and display that entry:

  • On the #HMOFOUNDIT Finds Wall;
  • In promotion-related social-media reposts;
  • In winner announcements; and
  • In records reasonably necessary to administer, verify, and document the Sweepstakes.

Sponsor may resize, crop, or format an entry for those limited purposes but will not materially misrepresent its content.

This entry license does not authorize paid advertising, product packaging, unrelated email marketing, merchandise, or another materially different commercial use. Sponsor will request separate written permission before such use.

An entrant may request removal from the public Finds Wall by contacting info@hobbymineroutlet.com. Removal will not require Sponsor to delete records reasonably retained for legal, security, fraud-prevention, or Sweepstakes-administration purposes.

Submitting an alternative email entry does not grant Sponsor permission to publish entrant content.

11. Privacy

Information collected through the Sweepstakes will be used to administer entries, verify eligibility, contact winners, deliver prizes, prevent fraud, comply with legal obligations, and perform the limited uses described in these Official Rules.

Information will be handled according to the Sponsor's Privacy Policy.

Entering the Sweepstakes does not subscribe an entrant to marketing email unless the entrant separately provides consent.

Entrants should avoid publishing precise find locations, private addresses, financial information, identification documents, or other sensitive information.

12. General Conditions

Sponsor may disqualify a person who tampers with the entry process, uses automated entry methods, interferes with the Sweepstakes, submits fraudulent information, or violates these Official Rules.

If fraud, technical failure, platform interruption, natural disaster, legal restriction, or another circumstance outside Sponsor's reasonable control materially affects the integrity or operation of a monthly Sweepstakes, Sponsor may suspend, modify, or cancel it, subject to applicable law.

No modification will be used to select a winner unfairly or retroactively reduce an entrant's legitimate opportunity to win.

Sponsor's failure to enforce one provision does not waive that provision.

13. Release and Limitation of Liability

To the extent permitted by law, entrants agree that Sponsor and the participating social-media platforms are not responsible for:

  • Lost, late, incomplete, corrupted, misdirected, or inaccessible entries;
  • Platform, network, hardware, software, or transmission failures;
  • Unauthorized interference with the Sweepstakes; or
  • Injury or damage caused by unlawful or unsafe conduct undertaken to create an entry.

Nothing in these Official Rules excludes liability that cannot lawfully be excluded.

Entrants remain responsible for lawful access, landowner permission, environmental compliance, and personal safety while prospecting.

14. Social-Platform Disclaimer

The Sweepstakes is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, X, TikTok, YouTube, or any other social-media platform on which an entry may appear.

Entrants provide their information to Hobby Miner Outlet, not to those platforms, except as necessary to use the applicable platform.

15. Disputes and Governing Law

Except where prohibited, these Official Rules and the Sweepstakes are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.

Any legal proceeding arising from the Sweepstakes must be brought in a court of competent jurisdiction located in Lincoln County, Oregon, unless applicable law requires otherwise.

Nothing in this section eliminates rights or remedies that cannot lawfully be waived.

16. Winners List

To request the winners list for a completed monthly Sweepstakes, email info@hobbymineroutlet.com with "#HMOFOUNDIT Winners List" and the applicable month in the subject line.

Requests must be received within 90 days after the applicable Entry Period ends.

17. Acceptance of Rules

By entering, each entrant confirms that they have read, understood, and agreed to these Official Rules and the applicable Monthly Promotion Notice.
